The Probate Division has jurisdiction over the estates of deceased persons and incapacitated and disabled minors and adults. The Division hears all litigation involving living trusts, as well as those trust established in last wills. Disputes involving transfers to minors, personal custodianships and durable powers of attorney are also heard in the Division. The Probate Division also considers petitions for 96-hour mental health commitments.

An attorney is required to file all probate proceedings, except refusals for a creditor, spouse or an unmarried minor child(ren). The Probate Division Party Information Sheet and court costs are required at time of filing.

Several forms are available for use in various probate legal actions, such as those relating to transferring a deceased person’s property to the spouse, unmarried child or children of the deceased, or to a person or business that the deceased person may owe money. 

NOTE: Court clerks may be able provide assistance in completing these forms. Users must contact their local court to determine those for which assistance is available.
